In other news;
I was away from dA for the better part of a year. Nothing to do with dA, just.. life stuff. One of the things I missed the most was the dArama™. Seems there is some new dArama™ happening in regards to art vs. porn, the faq, and the administration.

Someone reported something as porn, were told by the administration that what they reported was not porn, that they were misinterpreting the faq, and viola News!.

I take neither side on the issue per se. The imagery linked to in the article can be seen either way, depending on how you see the world. One particular image, the one from the ridiculously juvenile 3d game (a whole gallery full), I'd rather not see, not because I think its porn, but because its, well, ridiculous.

What really sparked this journal (which all of 3 people will read), was a certain poster copy/pasting some California penal code, and stating that dA are in violation of the law. Pffft. There are 3 problems with that;

a.) the penal code pasted was regarding under 18/under 16 acts specifically (which we all know dA certainly does not allow)

b.) a key term in the aforementioned penal code is "Knowingly", meaning that if a deviation contains prohibited material regarding a minor were to be reported and dA did nothing, then they would be in violation. If underage explicit content is reported, it is removed immediately.

c.) deviantART inc is a multi-million dollar corporation, I'm sure they have some farily adept lawyers and know where they stand in regards to the content allowed.

As I said, I take no side on the issue. If it turns out that some member(s) of staff were mistaken, and the images in question were indeed in violation, that's great. If they keep to their stance as a misinterpreted faq, that's okay too. In the interim, shouldn't we concentrate on reporting content that does not reside in the "gray area?"
